4. Health Information and Expert Services
Users may choose to provide health or wellness-related information when searching for, communicating with, or booking an Expert. PostParty may process information reasonably necessary to facilitate these interactions and provide the Platform. Experts are responsible for handling information they receive from or about Users in accordance with applicable privacy, professional, healthcare, and recordkeeping laws and their own professional obligations.
PostParty does not rely on a blanket representation that no health-related information or clinical information can ever pass through the Platform. Whether particular information is regulated as protected health information or other protected health data depends on the circumstances and applicable law.
5. Security of Consultations and Information
PostParty uses reasonable administrative, technical, and organizational safeguards designed to protect information transmitted and stored through the Platform. 6. Data Retention
PostParty retains professional, credentialing, tax, payout, transactional, security, and compliance information for as long as reasonably necessary for the purposes for which it was collected and as required or permitted by applicable law. You are responsible for complying with HIPAA, HITECH, and other federal or state healthcare privacy requirements to the extent those laws apply to you, your practice, or the services you provide. Nothing in these Terms represents or requires every Expert to be a HIPAA covered entity or business associate. PostParty may process information reasonably necessary to operate the Platform, facilitate bookings and communications, and provide Platform functionality as described in its applicable Privacy Policies.
